NOTICE: PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. BY ACCESSING THIS WEBSITE AND ANY PAGES HEREOF, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS BELOW. IF YOU DO NOT AGREE TO THE TERMS AND CONDITIONS BELOW, DO NOT ACCESS THIS WEBSITE, OR ANY PAGES HEREOF.   
The following Terms and Conditions apply to all online auctions conducted by The Real Bid Co., A California Corporation and has only the California Licenses. No other States properties are allowed to bid online at www.TheRealBid.com.  

We may add additional terms and conditions (the “Additional Terms and Conditions”) for this auction, and you will be required to acknowledge that you have read and understand any such Additional Terms and Conditions. Such Additional Terms and Conditions may include notification that there is a published or unpublished reserve, or that the results of the bidding at this auction are subject to Seller confirmation. In the event of any conflict between these Terms and Conditions and any such Additional Terms and Conditions provided by the Auctioneer, the Additional Terms and Conditions shall apply and shall supersede any conflicting provisions in these Terms and Conditions. 

Registration and Verification: In order to bid at this auction, you will be required to register at www.TheRealBid.com first and pay $1.00 with your credit card and only the winner will be charged an additional $999.00. The total of $1000.00 will be transferred to the escrow company as the initial deposit. The $1000.00 is not refundable.

Bidder Responsibility:
 Bidders must take care in entering bids, and each Bidder will be responsible for all bids placed under the Bidder’s approved registration. Once entered and recorded online, a bid is deemed to be final on behalf of the registered Bidder and may not be modified, retracted or rescinded in whole or in part. 
 

Bid Increments:
 $1000 or more.

Buyer’s Premium: A 3% Buyer’s Premium may be added to all bidder’s price. Any such Buyer’s Premium shall become part of the total purchase price in the Purchase Contract, and must be paid by the successful bidder. 

Extended Bidding Time:
 Notwithstanding the scheduled closing time for this auction, in the event that a bid is made at any time during the final five minutes of the scheduled bidding time, the bidding time will automatically be extended for an additional five minutes. For example, if the bidding is scheduled to close at 12:00 PM, and a bid is placed at 11:59 PM, the bidding will be extended until 12:04 PM.

Earnest Money Deposit: If you are the winner (successful bidder), you may then be required to tender an additional deposit in the form of a cashier’s check or wire transfer, within 48 hours or such other time as may be specified by the Auctioneer following the close of the auction, to be held by the Auctioneer or a designated escrow agent, all as set forth on www.TheRealBid.com or in the Additional Terms and Conditions. 

Closing: All sales must close within a period of time set forth in the Purchase Contract. Usually, seller allows 30 days or sooner for all cash sales and 45 days or sooner for finance transactions. If you believe you won’t be able to do so, you must contact the listing agent and gain permission in writing to protect the $1000 deposit.

Privacy Policy

This Privacy Policy describes how we handle your personal information on the TheRealBid.com. It applies generally to the website as well to the Seller Portal and Agent Portal, optional membership only sites. A current copy is maintained on the TheRealBid.com website at all times. This policy is subject to change at any time and users are encouraged to check it for changes regularly.

Collection of Data

When you use our Website or mobile applications, we collect a variety of information from you, including personally identifiable information. This information is obtained from your online registrations, searches, applications, surveys or forms you may complete. If you register to participate in an auction event, we may collect additional information from you, including financial and credit information, as well as details about the properties you choose to bid on and your bidding patterns and history. You may also provide information about third parties, for example, if you share property listings with others via e-mail. Further, we may collect information about your transactions with our affiliates or others, and may combine all information that is collected from your interactions with us, our affiliates and others. In addition, we may collect and store information such as your unique device identifier, the page or subject areas you visit, your browser program, Internet Protocol address, operating system and language, the state or country from which you accessed the Website or mobile application, the services you use, the information you request, the date and time of your visits, the websites you visited before and after visiting our websites, error logs, other hardware and software information, and the location of your wireless device in order to provide you location-based information. If you use any social networking functionality provided by us, we may access and use your social network profile information that you have made available to be shared.

We offer visitors to our Sites various services, which we may change from time to time. We may ask you to submit certain personal information so we can provide you with these services. When you visit our Sites, information may be collected through automated technologies such as cookies, web server logs and web beacons.   • Sellers or their agents to help them evaluate offers
  • Service providers under contract who help with our business operations (such as fraud investigations and bill collection).

  • Law enforcement or other governmental officials, in response to a verified request relating to a criminal investigation or alleged illegal activity. In such events, we will disclose information relevant to the investigation, such as name, city, state, zip code, telephone number, email address, User ID history, IP address, fraud complaints, and bidding and listing history.
 Without limiting the above, in an effort to respect your privacy, we will not otherwise disclose your personal information to law enforcement, other government officials, or other third parties without a subpoena, court order or substantially similar legal procedure, except when we believe in good faith that the disclosure of information is necessary to prevent imminent physical harm or financial loss or to report suspected illegal activity. We also reserve the right to transfer personal information we have about you in the event we sell or transfer all or a portion of our business or assets. Should such an event occur, we will use reasonable efforts to direct the transferee to use personal information you have provided to us on our Sites in a manner that is consistent with this Privacy Policy.

Your Rights and Choices

We offer you certain choices about how we communicate with you and what information we collect from you. TheRealBid.com provides features that allow you to (i) access and update personal information you have provided there or (ii) register your communications preferences, such as by telling us not to send you marketing materials. You also may contact us as described in the Contact Us section of the site to update your preferences, ask us to remove your information from our mailing lists or submit other requests.

Upon your request, we will close your account and remove your personal information from view as soon as reasonably possible, based on your account activity and in accordance with applicable law. We do retain personal information from closed accounts to comply with law, prevent fraud, collect any fees owed, resolve disputes, troubleshoot problems, assist with any investigations, and take other actions otherwise permitted by law.

General

We may amend this Privacy Policy at any time by posting the amended terms on this site. All amended terms automatically take effect 30 days after they are initially posted on the site. If your questions are not answered online, you may use the Contact Us form on the website.
